Terms and Conditions
OUR CONTRACT
You enter into a legally binding contract with Turners Sunblinds Limited on receipt of payment for the Goods in full or part.
PRICE
The price shown on the order confirmation page is the full price you pay. The price per blind is fully inclusive of VAT. In addition to the price, a delivery charge, currently of £7 is payable in respect of deliveries made to locations within the UK mainland. The delivery charge is shown on the order confirmation page. If You require delivery outside of the UK mainland You are advised to contact us in advance of placing Your order. If there is any change in the delivery charge payable We will notify You before Your order is processed.
RIGHT TO CANCEL OR AMEND YOU ORDER
BY YOU:
If you wish to amend or cancel your order after we have accepted it please contact Us as soon as possible by e-mail. Due to our quick processing of orders it is essential we are contacted within 24 hours of placing order otherwise your goods will already be in production. If the goods you have ordered have not been manufactured we will cancel your order, however we reserve the right to retain a handling charge of 30% of the full order value. If you wish to cancel your order and the goods have been measured or custom-made to your requirements these Goods will not be resaleable by Us. We regret that once Your order has been accepted by Us in relation to such Goods and entered on Our manufacturing process We are unable to accept any changes to these Goods or cancellation of Your order.
BY US:
We reserve the right to cancel Your order if: you require delivery outside the UK, the goods you requested are no longer available due to being discontinued and/or the price you have been quoted is incorrect due to a typographical error or error in the system.
If We do cancel your order we will notify you by e-mail and will re-credit your debit or credit card as soon as possible but in any event within 30 days of cancellation notice. We will not be obliged to offer any additional compensation for disappointment suffered.
If you order goods which are no longer available for any reason, such as stock shortages, discontinued line, we will contact you immediately to discuss alternatives. You then have the right to cancel your order and receive a full refund or amend your order to new specifications which have been offered to you by us.
PRODUCT DESCRIPTIONS AND MEASUREMENT
Product information and photographs contained within our web-site are provided for illustrative purposes only and We cannot warrant that they are accurate. If You are in any doubt as to the precise nature of the product or fabric You wish to order, You are advised to order a free sample of the product prior to placing your order.
The goods you order are made to measurements provided by you, with small deductions for purposes of fixings, and therefore it is very important that Your measurements are accurate. We cannot accept the return of the Goods by reason of the measurements provided being incorrect. If you are uncertain in any way how to measure for your blind you are advised to contact us prior to ordering.
Every attempt is made by us to ensure that the goods sold and delivered match in every respect any sample or description shown or given or sent to You, any minor or immaterial variation or change in colour or pattern between the sample or description and the Goods delivered shall not entitle You to reject the Goods nor to claim any compensation for such variation or change.
DELIVERING YOUR GOODS
We will deliver Your Goods to the address You have provided on the order form for delivery.
Ownership of, and risk in, the Goods will pass to You once they have been delivered to You. If goods are return by agreement from us, ownership of, and risk in the Goods returned will pass to Us on receipt of the Goods by Us.
DEFECTIVE GOODS
If Your Goods are damaged in transit you are advised not to sign the delivery paperwork as this document, when signed, confirms good are received in good condition. On refusal to sign for goods the courier will arrange for the return of item at their expense.
If the Goods are defective on delivery, you are requested to inform us by email within 24 hours of receipt. The goods will be returned to us for either repair to, or replacement of goods, whichever we deem appropriate.
If Goods are defective within the period of 12 months from delivery of the Goods, please contact us with details of defect and we will contact you to discuss replacement. If however good have been modified, misused or the subject of negligence, we reserve the right to refuse replacement, we may offer a repair service which you would be responsible for the payment of charges incurred regarding any repairs and collection and return of the Goods which We agree to carry out at Your request. We shall be entitled to debit such charge on the debit or credit card which You used to order the Goods provided We notify You of the amount of such charges before carrying out the repair.
Goods supplied are for domestic use by the consumer only. If you are wishing to re-sale and/or export the goods you must contact us by email only detailing your wishes prior to placing an order.
CREDIT CARD PAYMENTS
Upon receipt of your order we reserve the right to carry out a credit reference or other enquiry upon your financial status if we deem necessary.
EVENTS BEYOND OUR CONTROL
We do not have any liability to you for failure or delay to deliver Goods you have ordered or for any damage or defect that is caused by any event or circumstance beyond our reasonable control including, without limitation, third party default, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
PRIVACY
Be assured that any details which are supplied to us will not be passed on to any other company and will remain private and undisclosed.
THIRD PARTY RIGHTS
Except for Our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
GOVERNING LAW
This contract is subject to English law and the exclusive jurisdiction of the English courts.
